Reports are that Liverpool have 6 credible take over bids on the table, the best of which seems to be a Chinese chap who is only willing to pay off the debt , leaving the Americans with nothing. As they wanted £800 million they are hardly likely to say yes. The Chinese chap says it has to be signed sealed and delivered in 2 weeks. What of this due diligence thing? Surely that takes longer than that, and also the leagues new tightened up more rigorous fit and proper persons test?
Actually he will get it cos his name is Kenny and most of the scousers won't be able to see beyond that.

the fit and proper persons thing is a joke, but that, along with due dilligence and hicks and gillettes general refusal to walk away with nothing will mean that the deal will either not take place in time or too late to do anything

When Frank was able to buy Manchester City without a hitch, the whole "fit and proper" thing became a joke.

And as for due diligence, unless all these buyers have had their bean counters going through the Liverpool books for the last few months then this is being ignored.

Am I right in thinking that the control of the club is already partly out of the hands of Gilett and Hicks and more in the hands of RBS as they've failed to meet all their covenants?

The FA can't really apply a fit and proper criteria as it wouldn't stand up in a court anyway.

Only the debt part of it is with RBS and that is what they are interested in. Gillett and hicks want that paid off and a profit for themselves on top and I think that is going to bethe stumbling block .

The Premier League have introduced new ownership and financial regulations in an attempt to avoid a repeat of Portsmouth's financial problems.

Cash-strapped Portsmouth, who were in the High Court on Tuesday in relation to their ongoing battle with the tax man, ran up massive debts with creditors and were placed into administration.

In response to Portsmouth's problems, the Premier League have implemented tougher new rules on club ownership meaning all prospective owners are obliged to give the league ten days' notice of a takeover and prove they have the funds to sustain the club.

It is understood Liverpool and a number of parties contemplating a takeover - including Chinese businessman Kenny Huang - have already contacted the Premier League to alert them a change of ownership could be imminent.

Under the rules, the Premier League will have to be given ten days' notice of any takeover, and the prospective owners will be required to have a face-to-face meeting with league chiefs to convince them they have enough money for the season to come.

Other rule changes will see clubs having to provide evidence every quarter that they are up to date with tax payments to Her Majesty's Revenue & Customs - and they will give permission for HMRC to give details on any non-payment directly to the league.

The former 'fit and proper persons test' has been renamed as the 'owners and directors test' and toughened up. Now anyone barred from other sporting organisations or competitions will not be allowed to be a club director.

The strengthening of the regulations is an attempt to reduce the risk of another crisis similar to that suffered by Portsmouth, who went into administration last season and were subsequently relegated.

Premier League chief executive Richard Scudamore said: "We believe we have the measures now in place, the early warning system, that will reduce the risk of having a repeat of the Portsmouth situation.

Objective

"The objective of the Premier League is to reduce risk and try to prevent the worst happening but we can't eliminate risk entirely as that would involve us interfering as shadow directors in the running of clubs.

"There was reputational damage with the situation we had with Portsmouth. Clubs get tired of football being called a financial basket case. There was an element of gross mismanagement [with Portsmouth] and people have understood it was the exception rather than the rule."

Scudamore believes the league could have intervened in Portsmouth's finances in January 2009 rather than September if the new rules had been in force then, and stopped the club running up such debts with the taxman.

He added: "The HMRC debt would not have run up and we would have probably been able to prevent some of the worst."

Scudamore admitted he believed the new rules on future financial information would have prevented Ali Al Faraj from taking over Portsmouth in October last year, though not Alexandre Gaydamak from doing so in 2006.

Steven Gerrard believes Liverpool are set for a bright new era under Roy Hodgson after the "horror" of last season – and claims that the new signing Joe Cole is better than Barcelona's Lionel Messi.

Gerrard, in an interview with Match of the Day magazine, said the new manager has already given Liverpool a lift after a disappointing seventh-place finish last season.

"It's a great club and after speaking with Roy Hodgson I'm really pleased to see his plans for the club. It's a new era now – we must forget about the horror of what happened last season and get this club back to where it belongs, which is the Champions League at the very least."

Gerrard said Cole, signed in July on a Bosman from Chelsea, has the ability to drive the team forward.

"[Lionel] Messi can do some amazing things, but anything he can do Joe can do as well, if not better. He used to shock us in training by doing footy tricks with a golf ball that most players can't even do with a football. I really fancy Joe for the [player of the year] award this season."
